Processing purposes and legal bases of the processing of your personal data

We process your personal data for the following purposes:
 

1. customer service

If you contact us by telephone, e-mail or post, e.g. to find out about our products, for a spare part or repair or for a product recall, we process your personal data in order to process your request and answer your query.

We process the following categories of personal data:

- Identity data,
- Contact details,
- Contract and billing data,
- other communication content that is required to clarify the request or to execute the order.

Your data is processed so that we can manage you as a customer in our systems and fulfill our contractual obligations towards you. In addition, we store your data for the assertion, exercise or defense of legal claims.

The legal basis is Art. 6 para. 1 lit. b and lit. f GDPR.

If you have given your prior consent, we will record individual telephone calls for quality assurance purposes and to train customer advisors. Consent is given via the voice dialog system and is documented with the corresponding communication connection data.

In addition, if you agree, you will be asked about your satisfaction with the customer service immediately after the telephone call. This evaluation is used for quality assurance purposes and is stored by us in anonymized form.

The legal basis is Art. 6 para. 1 lit. a GDPR. You have the right to withdraw your consent at any time with effect for the future (see section "Your rights").
 

2. competitions and other marketing measures

We process your data in accordance with the conditions of participation in order to carry out the competition, to notify you of a prize and to process the prize by mentioning your name or your Instagram account. The legal basis for the processing is Art. 6 para. 1 lit. a or lit. b GDPR.
 

3. Log files, cookies, web analysis services, identifiers and retargeting
When you visit our website, the Internet connection data that your browser transmits to our server is processed first. Our website collects a range of general data and information each time it is accessed, which is temporarily stored in server log files. A log file is created as part of an automatic log of the processing computer system. Among other things, the following can be recorded

  • Access to the website (date, time and frequency)
  • How you reached the website (previous page, hyperlink, etc.)
  • Amount of data sent
  • Which browser and browser version you are using
  • The operating system you are using
  • Which internet service provider you are using
  • Your IP address, which your Internet access provider assigns to your computer when you connect to the Internet.

The legal basis for this data processing is Art. 6 para. 1 lit. f GDPR or lit. b GDPR as well as § 25 para. 2 no. 2 TDDDG (Telecommunications Digital Services Data Protection Act), as the processing of this data is necessary for the operation of the website in order to ensure the functionality of the website and to deliver the content of our website correctly. In addition, we use the data to optimize our website and to ensure the security of our IT systems.

We use cookies, analysis tools and other technologies for improved functionality, analysis, personalization of content and advertisements on our website and third-party sites (retargeting) as well as for a complete shopping experience. For this purpose, we work with solutions developed in-house or use solutions from service providers. The legal basis is Art. 6 para. 1 lit. a, Art. 7, partly Art. 49 para. 1 lit. a GDPR and § 25 para. 1 TDDDG.

Data recipient

In individual cases, your data will be passed on to the recipients listed below (contracted service providers and cooperation partners). We require all recipients to guarantee the security of your personal data and to process it in accordance with applicable law.

 

1. affiliated companies

The MediaMarktSaturn Retail Group companies affiliated with us will receive your data if this is necessary to enable us to provide all services in the area of own brands.

In particular, we transmit data to the store or online store of the MediaMarkt and Saturn sales divisions where you purchased our product and to the Group's Legal and Insurance divisions for the purpose of processing complaints, product liability cases and product recalls in order to settle claims.

The legal basis for this is Art. 6 para. 1 lit. b or lit. c GDPR.

 

2. third parties and processors

In order to fulfill our contractual and legal obligations, we also use external service providers. Your data may be passed on to the following recipients, among others:

  • Cooperation partners, if necessary in the context of processing warranty/guarantee cases and repairs,
  • Capita West GmbH, Nassauer Ring 39-41, 47803 Krefeld, in connection with call center services,
  • service providers, e.g. for the dispatch of parcels and letters or for payment processing,
  • Processors within the meaning of Art. 28 GDPR, e.g. to ensure our IT operations,
  • in the event that you do not settle outstanding claims despite reminders, we may transfer the data required to carry out debt collection to a debt collection service provider for the purpose of fiduciary collection.

The legal basis is Art. 6 para. 1 lit. b or lit. f GDPR.

 

Data transfer to third countries

We attach great importance to processing your data within the EU. However, we may use service providers who process data outside the EU ("third countries") for the administration, development and operation of IT systems and for marketing and customer communication. In these countries, despite careful selection and commitment of the service providers, the high European level of data protection cannot necessarily be guaranteed. If data is transferred to the USA, for example, there is a risk that this data may be processed by US authorities for control and monitoring purposes without effective legal remedies being available or all data subject rights being enforceable.

If we use service providers in third countries, we take additional measures to ensure an adequate level of data protection when transferring personal data in accordance with Art. 44 ff GDPR and thus ensure that the transfer is generally permissible and that the special requirements for a transfer to a third country are met (e.g. by concluding EU standard contracts and additional guarantees, additional technical and organizational measures, such as encryption or anonymization).

If any data transfer is based on your consent, the declaration is voluntary. This then also includes your consent pursuant to Art. 49 para. 1 lit. a GDPR for data processing outside the EEA, e.g. in the USA. You can withdraw this consent at any time as described in the section "Your rights".

 

Duration of storage and routine erasure of personal data

We process and store your personal data only for the period required to fulfill the purpose of processing or if this is provided for in laws or regulations. Once the purpose no longer applies or has been fulfilled, your personal data will be deleted or blocked. For example, recordings of telephone conversations are automatically deleted after six months.

In the case of blocking, deletion takes place as soon as there are no legal or contractual retention periods to the contrary.

 

Your rights

You naturally have rights with regard to the collection of your data, which we would like to inform you about. In accordance with the statutory provisions, you have the right

  • to information from us about the personal data concerning you (Art. 15 GDPR)
  • to rectification (Art. 16 GDPR)
  • to erasure (Art. 17 GDPR)
  • to restriction of processing (Art. 18 GDPR)
  • to data portability (Art. 20 GDPR)
  • to object to the processing (Art. 21 GDPR) If your personal data is processed on the basis of legitimate interests in accordance with Art. 6 para. 1 lit. f GDPR, you have the right to object to the processing at any time in accordance with Art. 21 GDPR.
  • to withdraw your consent (Art. 7 para. 3 GDPR) If your personal data is processed on the basis of consent, the lawfulness of the processing carried out until the withdrawal is not affected by the withdrawal.
